Precies dat gebeurde bij Ripple, het bedrijf achter XRP. CEO Brad Garlinghouse vertelde onlangs dat stoppen een re\u00ebel scenario was nadat de Amerikaanse toezichthouder SEC in 2020 een rechtszaak aanspande. Een opvallende bekentenis, zeker nu XRP weer volop in de belangstelling staat.<\/p>\n\n<h2 class=\"wp-block-heading\">Waarom Ripple bijna stopte<\/h2>\n\n<p class=\"wp-block-paragraph\">Waar ging de ruzie precies over? De SEC vond dat Ripple XRP had verkocht als een effect, zonder dat netjes te registreren. Een effect is bijvoorbeeld een aandeel of obligatie, en daar gelden strenge regels voor. Ripple zag XRP juist als een gewone cryptomunt. Dat verschil klinkt technisch, maar het bepaalt of je je aan die strenge effectenregels moet houden of niet.<\/p>\n\n<p class=\"wp-block-paragraph\">Voor een Amerikaans bedrijf is zo&#8217;n aanklacht geen kleinigheid. Het raakt aan wie er nog zaken met je durft te doen en of je \u00fcberhaupt toegang houdt tot de belangrijke Amerikaanse markt. Volgens Garlinghouse stonden hij en medeoprichter Chris Larsen voor een simpele maar zware keuze: vechten of ermee stoppen. Uiteindelijk kozen ze voor vechten. Grote Amerikaanse handelsplatformen haalden de munt tijdelijk uit de schappen, en de koers stond lang onder druk terwijl de rest van de markt gewoon bewoog. De ene vraag hing als een schaduw boven alles: telt XRP nu wel of niet als effect?<\/p>\n\n<p class=\"wp-block-paragraph\">Zo bekeken is de keuze om door te vechten goed te begrijpen. Was Ripple gestopt, dan had het bedrijf het stempel &#8220;niet-geregistreerd effect&#8221; eigenlijk zelf bevestigd.<\/p>\n\n<h2 class=\"wp-block-heading\">Waarom dit voor jou als lezer interessant is<\/h2>\n\n<p class=\"wp-block-paragraph\">Goed om te weten: dit was vooral een Amerikaans probleem. In Europa werkt het anders. Met de nieuwe regels van MiCA krijgen cryptovaluta hier een eigen categorie, los van aandelen en obligaties. Daardoor speelt die effectenvraag bij ons veel minder.<\/p>\n\n<p class=\"wp-block-paragraph\">De belangrijkste les zit niet in XRP zelf, maar in het grotere plaatje. Duidelijke regels geven bedrijven de ruimte om te bouwen, terwijl onduidelijkheid een project zelfs aan de rand van de afgrond kan brengen.
